"Additional charges may be filed based on the results of a pending blood alcohol content analysis", the Denver District Attorney's office said in a statement on Tuesday.

The 29-year-old was off duty when he was performing for a crowd at the Mile High Spirits bar in Denver, Colorado nightclub on June 2.

"We are filing this charge now rather than waiting until the BAC report is received, which we understand could take another week, because sufficient evidence has been presented to file it", Denver District Attorney Beth McCann said.

After doing a black flip on the dance, Bishop's gun fell out of its holster and fell to the floor. "If an additional charge needs to be filed after further evidence is received, we can file those charges then".

An FBI spokeswoman would not comment on the incident "in order to preserve the integrity of the investigation", the Associated Press news agency reported.

Sanders said the field office would fully cooperate with Denver police and prosecutors "as this matter proceeds through the judicial process". He then placed the gun in his waistband and walked off the dance floor with his hands in the air, the video shows.

An attorney for the victim told CNN affiliate KMGH that the bullet hit the victim's main artery and that he could have bled to death, if not for a person who applied a tourniquet to the victim's leg.

Special Agent Amy Sanders, a spokeswoman for the Federal Bureau of Investigation field office in Denver, declined to comment on Bishop's employment status with the agency.

The bar also said the patron who was shot is welcome to complimentary drinks forever at the bar.
