"We are unable to accept the contention of the government that the accused can not be arrested". The lawmaker from Bangarmau in Unnao district has also been charged under Sections 363 and 366 (kidnapping of a minor girl), 376 (rape) and 506 (criminal intimidation) of the Indian Penal Code.

"She (victim) is just implicating Sengar in a false case because she knows that if he goes to jail for rape, he will not get bail easily". Her age is yet to be ascertained.

The CBI on Saturday also took into custody Shashi Singh, the woman who allegedly took the victim to the MLA on the day of the crime in June a year ago. Now three cases has been registered against Kuldeep Singh Sengar.

Some of the suspects are accused of attacking the victim's father on April 3.

This comes a day after a senior BJP leader in Uttar Pradesh claimed that the Chief Minister had chose to arrest the accused MLA but his decision was changed after the intervention of a "prominent person".

The case was handed over to the CBI based on the findings of a probe team formed by the UP government after the teenager tried to commit suicide outside Yogi Adityanath's house on Sunday.

"If a girl's father has been beaten up with lathis two days ago, how can she be raped?" Later, the rape victim's father was arrested, and on Monday, he died in hospital. The agency recorded statements of her and the family for more than three hours.

"The DGP and the Principal Secretary (Home) were shielding the accused".

Sources said the questioning is going on at the CBI office in Lucknow. The development had sent raised serious questions on the Yogi Adityanath government in Uttar Pradesh.

Demanding a proper inquiry into the brawl, he said, "An FIR should be registered and the culprits should be booked". The third one relates to Sengar's brother Atul Singh, who claimed that he was attacked by the victim's father.

Asked why he was giving Kuldeep so much respect, the state's police chief said: "He is only an accused and not a convict".

Meanwhile, the victim's family expressed satisfaction on the arrest of the MLA. He also added that the opposition party is anti-nationalist.

Accusations against Sengar and his eventual arrest comes as a major embarrassment for Uttar Pradesh's BJP government.
