Apple ordered to pay $502.6 million in patent infringement case

In 2012, Apple lost a $368.2 million lawsuit from VirnetX, though that verdict was later thrown out, paving the way for retrials and additional disputes. The patent troll claimed that FaceTime, iMessage and VPN on Demand violate four of its patents that are related to secure communications. It isn't the first time a ruling in the case has gone against Apple.

The Federal Circuit, which handles all patent appeals, declined to put this trial on hold, saying it was so far along that a verdict would come before a final validity decision.

VirnetX CEO, Kendall Larsen called the half-billion sum "fair", according to a Bloomberg News report which went on to note that this week's infringement penalty is pursuant with the Apple's sale of "more than 400 million devices" including premium iPhone and iPad models.

If this feels familiar, it's because we've been here before, and Apple isn't VirnetX's only target. Later on, the company was ordered by the district court to pay more than Dollars 400 million as damages to the patent-holding company VirnetX for copyright violations. A jury had already awarded VirnetX $302 million, which was later increased to $439.7 million and has now gone up to $502.6 million.

Meanwhile, back in 2016, the U.S. Patent & Trademark Office's (USPTO's) Patent Trial and Appeals Board (PTAB) moved to invalidate four of VirnetX patents - two of which were apparently leveraged in the latest case, resulting in this week's judgment. That's because PTAB believes VirnetX's patents are invalid even for cases now in progress.
