LA Family's Lawsuit Says Starbucks Served Blood-Stained Frappuccino

In February 2016, Amanda Vice, her husband, Louis, and his mother ordered drinks from a San Bernardino Starbucks and noticed a red smear and a "strong metallic smell" on one of the cups, KTLA reports.

"We felt sick to our stomachs", Vice told the station.

After ascertaining that no members of the family had been bleeding, they contacted Starbucks to inform them of what had happened.

"My wife and my baby just drank someone's blood", Louis Vice said.

The family was adamant in saying that none of them had noticed any bleeding among themselves, hence, they called Starbucks to confirm the same, only to find out that an employee at Starbucks had been bleeding and had been removed from the floor, as per the complaint.

While the family was "extremely concerned" over the contaminated beverages, the manager offered the family free drinks for a week, according to the release.

The news release states that the family underwent extreme emotions of "anguish, fright, horror, nervousness, grief, anxiety, worry, shock, humiliation, and shame", and so they want to be compensated accordingly.

The lawsuit seeks damages for failure to warn, negligence, breach of express warranty, breach of implied warranty, fraud, intentional infliction of emotional distress, battery, assault, negligent hiring and negligent training and supervision. She didn't know if ingesting the blood could get them sick. According to the lawsuit, the store did not require the testing. Instead, the family had to get their own tests done. The results were negative, fortunately, and Starbucks reportedly offered $1,000 to each family member to make amends. He said filing a lawsuit two years later is their last resort.

"We didn't want to race to the courthouse", Pekler said. It's been accused of underfilling lattes, serving coffee drinks too hot and serving them at all (without cancer warnings, that is).

Earlier this year, a location near Atlanta had to close after false statements went viral on social media, claiming a black employee had been defiling white customers' food and drinks.

"In this instance, we've been working with the family directly since nearly immediately after they informed us of their experience", he said.

A Starbucks representative told KTLA that the company is aware of the lawsuit and is prepared to present its own case in court.
