Judge rejects Roman Polanski victim's bid to end case

Neither Polanski nor Braun seek to justify the director's conduct in 1977 that led to the case, but they question "the honesty and integrity of some members of the criminal justice system" and hope the current court "has the wisdom and competence to resolve this ancient case".

Ms Geimer, who has three sons and now lives in Hawaii, said in June that Polanski had apologised to her years ago, but that she continued to remain a victim because of media attention each time there was a new development in the case.

Polanski pleaded guilty to having unlawful sex with Geimer under a deal that spared him more serious charges claiming he drugged, raped and sodomized the minor.

After 42 days in detention in order to undergo a psychological examination, he was released to be able to finish a shoot.

The 83-year-old Polanski has since been living in Europe as a fugitive.

The judge's decision on Friday came after the alleged victim, Samantha Geimer, had appealed in June for the case to be dismissed so that she could move on. She has been asking the court to terminate this case for years.

The rape occurred at Jack Nicholson's Mulholland Drive home during a photo shoot.

He makes no denial of it, accepting it was "morally and legally wrong", according to his lawyer.

"Ms. Geimer came to court, presented herself and begged the four decades old case be over".

His lawyers have been fighting for years to end the case and lift an global arrest warrant that confined him to his native France, Switzerland and Poland, where he fled the Holocaust.

Roman Polanski, the director behind films like Rosemary's Baby and The Pianist, will still face trial, an LA judge has decided.

He was also nominated for 1974's Chinatown and 1979's Tess.

Polanski contends he is the victim of judicial misconduct because the now-deceased judge who handled the case suggested in private remarks that he would not honor a plea bargain agreement.
