Eric Bolling suing for defamation following suspension at Fox

Eric Bolling suing for defamation following suspension at Fox

Eric Bolling is reportedly suing the Huffington Post reporter who broke a story claiming the Fox News host had sent several female co-workers lewd photos.

Court filings from the New York State Supreme Court reveal that Yashar Ali, a HuffPost contributing writer, was issued a summons notice to appear in court.

The summons accuses Ali of "reckless publication of actionable false and misleading statements about the plaintiff's conduct and character". "I stand by my reporting + will protect my sources", Ali tweeted.

Bolling is represented by Michael Bowe - a lawyer from the same firm as Marc Kasowitz, President Trump's personal attorney until July.

Bolling's suspension from Fox News happened after Yashar cited more than a dozen sources last Friday to report that the Fox News host texted female Fox News colleagues an "unsolicited" photo of his penis.

After the initial report, Bolling said, via his lawyer, that he "recalls no such inappropriate communications, does not believe he sent any such communications, and will vigorously pursue his legal remedies for any false and defamatory accusations that are made".

UPDATE 6:10 PM ET: The headline has been corrected to show that Bolling hasn't actually filed the lawsuit yet, but has served a summons to show that he is planning to sue Ali.

Ali's reporting relied exclusively on anonymous sources. "We are investigating this matter and all claims will be taken into account". Bolling, particularly if he didn't do it (and he enjoys a presumption of innocence under the law) is taking the only step he can be challenging his accuser in #Open Court in a shock and awe gambit to clear his name. In the sort of response any freelancer would appreciate, HuffPost Editor in Chief Lydia Polgreen tweeted, "Yashar Ali is a careful and meticulous reporter".

"Not going to stop reporting on Eric Bolling or anyone else", Ali tweeted.

Fox has been hit by a series of lawsuits against former network CEO Roger Ailes and former anchor Bill O'Reilly. The network is also looking into a separate claim by frequent Fox News guest Caroline Heldman that Bolling sexually harassed her.

Bolling was a former commodities trader who worked as an on-air personality for CNBC before joining Fox Business when it launched in 2007. When Weiner pleaded guilty earlier this year to sending obscene material to an underage girl, Bolling said he was a "sick human being, to continue to do this time and time again".
